DUI & Child Endangerment Penalties
In order for an individual to be found guilty of the penalty enhancement for having a minor child in the car, (1) the person must be convicted of a DUI and (2) the prosecution can demonstrate that the individual had a minor in the vehicle who was under 14 on the date of the incident of driving under the influence. The prosecution has the option of either enhancing the underlying DUI sentence, make child endangerment a separate charge, or both.
Sentence enhancements include the following:
- 48 hours in a county jail for a first DUI conviction
- 10 days in jail for a second DUI conviction
- 30 days in jail for a third DUI conviction
- 90 days in jail for a four or subsequent misdemeanor DUI conviction
If you are separately charged with a child endangerment, it is considered a “wobbler,” meaning that you can either be charged with a misdemeanor or felony depending on the circumstances. A misdemeanor charge is punishable by a jail sentence of one year, while a felony is punishable by a prison sentence up to six years.
